The system of protection for unemployment provided for the collective of the Special System for Agricultural Workers, presents some characteristics of its own as they are directed to fixed, fixed, discontinuous or temporary workers.

While permanent and permanent workers may have access to unemployment benefits and allowances, they may do so under the same conditions as any non-agricultural employee of the General Social Security System.

From the 17 March of 2022 , workers with a discontinuous fixed contract included in the Special Agrarian Social Security Regime who carry out this activity in the autonomous communities of Andalucía and Extremadura when they cease to provide services because the intermittent or seasonal activity of the enterprise has ended or has ceased or when the activity is suspended due to economic, technological or force majeure reasons, or when after these situations they involuntarily cease in a possible agricultural work, for the purposes of unemployment protection they will be considered both permanent discontinuous workers and temporary workers of the Special Agrarian Social Security Regime.

Therefore, as long as you meet the rest of the requirements required in each case, you can choose:

1. For unemployment benefits of contributory or assistance level, the duration of the subsidies being the same as for the rest of the working people of the general regime.
2. Unemployment allowance for temporary workers covered by the Special Agrarian Social Security Scheme, including special allowance for temporary workers who are older than 5 years of age; 52 years, or, where appropriate, for agricultural income, in favor of the same people, considering the working person as a possible agrarian.

For all purposes, and not only to determine whether the minimum number of real working days required for access to the SEASS subsidy or the Agrarian Income is covered, all the real working days listed in the Special Agrarian Social Security Regime will be taken into account, regardless of their number, as a permanent agricultural worker and as a temporary agricultural worker, provided that:

• have not been calculated to obtain a prior entitlement, unemployment benefit, unemployment benefit or agricultural income; and
• have been covered in 12 Natural months immediately preceding the unemployment situation.

The actual days quoted will also be taken into consideration for the duration and amount of the rights that may correspond to them (disp. transitory. 2 DR 5 / 1997 and arts. 4 and 5 delRD 426 / 2003 ).

They will not be included in the income count of the applicant or beneficiary, nor of the members of the family unit, those obtained by agricultural work as an employed person of a discontinuous fixed nature.

Temporary workers residing in the autonomous communities of Extremadura and Andalucía They may be entitled to the subsidy for agricultural contingents (if they have received it in any of the three calendar years immediately prior to the date of application and meet the other requirements), or if they are not entitled to this subsidy, they may have access to the agricultural income.

The payment of these unemployment benefits will be made, except for exceptions, by means of the payment in the account of the financial entity that you indicate to us, provided that you are the owner of the same.
