Requirements

  • Assume the commitment to return to your country of origin, if applicable, in the company of members of your family reunited who do not have independent residence authorization, within a maximum period of 30 calendar days from the date of the first payment in Spain. , and the commitment not to return to Spain within three years.
  • Not be affected by any of the cases of prohibition of leaving the national territory provided for in the immigration legislation.

Can I return to Spain in the future?

You will not be able to return to Spain until you pass the three-year non-return commitment period, and as long as you previously request work and residence authorizations in Spain again. In no case will you be able to return before the end of that period to reside and/or carry out a lucrative or professional activity, even if you would like to return the amounts you have received as an accumulated and anticipated payment of the contributory unemployment benefit for the voluntary return to your country. originally.

Once you have approved the right to advance and accumulated payment of the contributory unemployment benefit, after thirty calendar days from the date of the first payment and without the need for another administrative procedure, the residence authorizations of which you are the holder will be extinguished.

After a period of three years has elapsed since your departure from Spain, you will have a preferential right to join the contingent of non-EU foreign workers, as long as you justify the requirements set out in current regulations on immigration and immigration.

If you were a temporary resident in Spain and decide to return legally at the end of the three-year non-return commitment period, your residence status will continue in order to complete the period you needed to obtain, if applicable, permanent residence. If you had permanent residence in Spain and return after completing the three-year non-return commitment period, you will be able to recover your permanent resident status through a simplified procedure.
